NEWSLETTER REGULATIONS

  1. Jarosław Majtczak, running the company under the name of P.P.H.U."BEROTEX" JAROSŁAW MAJTCZAK headquartered in Łodź (93-613), ul. Kolumny 221, entered into the Business Activity Central Register and Information Record System, chaired by the Minister for Development, having the VATIN: 7291832386 and TIN: 471424703 hereinafter referred to as the “Service Provider”, provides electronically via e-mail addresses on request of the individuals, legal persons, or organizational units without legal personality, which benefit from the services provided by electronic means, hereinafter referred to as “Service Users”, a free service, hereinafter referred to as “Newsletter” under the terms of the Act of July 18, 2002 on electronic services and to the extent specified in the Regulations.

  2. The newsletter is a service consisting of notifying the Service Users about the Service Provider offers, promotions, contests, events and news related to the commercial offer of the Service Provider, including information about the reviews and press releases related to the Service Provider’s economic activity. The content of the Newsletter will contain information text along with graphics (icons, logos) and links to the websites of the Service Provider.

  3. Using the Newsletter service depends on whether the Service User is in a disposition of a computer or any other media device with the access to the Internet and on the possession of the active e-mail address account by the Service User.

  4. To activate the service it is required:

a) to voluntarily enter the Service User’s address of the electronic mail (e-mail) in the form posted on the Service Provider’s website or by the registration by selecting the appropriate field,

b) to consent to receive at the provided electronic address (e-mail) commercial information within the meaning of the Act of July 18, 2002 on electronic services,

c) to accept these Regulations,

d) pressing (clicking) onto „Subscribe”.

  1. Frequency of sending a Newsletter will be varied and dependent on changes in the commercial offer of the Service Provider or the occurrence of serious events related to his business activity, provided that such a service will not be performed more than 20 times a month.

  2. Newsletter service is provided within an indefinite period.

  3. Electronic letter (e-mail) containing the Newsletter also contains information no how to resign from the service.

  4. The Service Provider declares that under the provision of the services described in these Regulations, the Service User is banned to supply and convey any information of illegal content.

  5. The Service User, who has properly placed the order for the provision of the Newsletter service hereby declared that:

a) possesses the legal capacity to act and that the provided by him in the order the electronic address is the address that the Service Provider has the right to dispose of to the extent required for the fulfillment of the service;

b) agrees to receive information described in paragraph 2 of the present Regulations.

  1. Providing in the application form or during the registration operations of the electronic address (e-mail) of the Service User is required to provide the service of the Newsletter. Indicating other personal data in the form is not necessary and is in the realm of the recognition of the Service Users and their processing is a subject to the consent of the Service Provider. These data are used to determine the Service User’s profile and allow him to customize the content of the Newsletter to his needs. The Service Provider declares that in connection to the provision of this service, in addition to the e-mail address the Service Provider does not process any other personal data of the Service User associated with this service.

  2. The Service User has the right to access the content of its personal data and to correct them.

  3. The Service User has the right to be informed whether and to what extent his personal data is processed, as well as the information about the purpose and extent of the processing of his personal data.

  4. The Service Provider may at any time, without giving any reason and at no cost, change the previous indicated e-mail address, to which the Newsletter is sent, or cancel the Newsletter service (revoke the consent to receiving information referred to in section 2 of the Regulations) by clicking on the link provided in footnote of each Newsletter by typing in the appropriate field your e-mail address and then selecting the button “Unsubscribe”/”Resign from service”.

  5. After receiving the notice of the cancellation, as well as after the services have been withdrawn for reasons specified in paragraph 23 the Service Provider will remove the e-mail address of the Service User from its shipment base.

  6. The complaints regarding the Newsletter service provided by the Seller can be submitted via electronic addresses to the e-mail address: shop@berotex.net.

  7. Admitting a complain should include in particular: a description of the matter, which the complaint concerns, electronic address (a-mail), provided during the registration for the Newsletter service or electronic address (e-mail) or the correspondence address, to which the answer to the complaint should be sent if the Service User wishes to receive an answer to the complaint by the post or by the electronic post to an address that is different from the electronic address (e-mail) provided during the registration for the Newsletter service. The Service Provider must also indicate his preferences as to how the complaint should be handled.

  8. The processing of the correctly issued complaint and granting the answer on its further consideration, will take place within fourteen days from the date of the receipt of the notification by the Service Provider. The Service User will be informed about the method of handling the complaint in accordance with the data indicated in the submission of the complaint. In the event of any deficiencies in the submitted complaint, the Service Provider will contact the Service User with the request to complete them in accordance with the address data indicated in the submission of the complaint.

  9. The Administrator of the User’s personal data, provided due to being able to get access to the Newsletter service is Jarosław Majtczak, running the company under the name of P.P.H.U."BEROTEX" JAROSŁAW MAJTCZAK headquartered in Łodź (93-613), ul. Kolumny 221, entered into the Business Activity Central Register and Information Record System, chaired by the Minister for Development, having the VATIN: 7291832386 and TIN: 471424703.

  10. The Service Provider processes the collected personal data in accordance with the Act of July 18, 2002 on electronic services and the Act of August 27, 1997 on data protection. The Service Provider, as the personal data Administrator, may entrust another entity, by a written contract, the processing of personal data, in accordance with article 31 of the Act of August 27, 1997 on data protection.

  11. The entity to which the Service Provider entrusts the processing of the personal data in accordance with the article 31 of the Act of August 27, 1997 on data protection, with whom the Service Provider has made an appropriate agreement required by the above mentioned provision, is FreshMail Sp. z o.o. headquartered in Kraków (31-406), ul. Al. 29 Listopada 155 c, having the VATIN: 6751496393, TIN: 123040091. The objective of entrusting the data is the inclusion of the Newsletter service covered with the provisions of these Regulations, the extent of the transmitted data is determined by the content of the paragraph 10 of the Regulations, and the intended date of the submission of the data covers a period of providing the Newsletter services by the Service Provider in favor of the Service User.

  12. The Service Provider reserves the right to change the Regulations. The Service User will inform the about the content of the amendments to the Regulations by placing on the website www.berotex.net the information about the amendments to the Regulations, containing the statement of changes to the Regulations and maintaining the information on the above mentioned website for at least fourteen consecutive calendar days. The Service User will be additionally informed about the amendments to the Regulations by a message via the Newsletter and by the electronic post (e-mail), provided during the registration, information stating the changes to the Regulations. Informing about the changes to the Regulations will occur no later than fourteen calendar days before the introduction of the emended Regulations.

  13. Amendments to the Regulations enter into force on a specified date along with the information about the changes, but not earlier than after fourteen calendar days from the moment of notifying about the changes to the Regulations, with the reservation that the revised Regulations will link the Service User, provided that in the case of the lack of the acceptance of the new content of the Regulations within fourteen days from the date of the receipt of the information about the changes, does not indicate that he is resigning from the Newsletter service.

  14. The Service Provider reserves the right to quite at any time the provision of services described in section 2. The Service User should inform the Service Provider about the intention to quite the provision of services with at least fourteen days in advance by sending an appropriate notification on that matter by electronic mail to the electronic address provided by the Service User at the conclusion of the contract. The Service Provider reserves the right to temporary cessation of the services, if this is necessary for technical reasons (maintenance, modification or repair of the system).

  15. These Regulations are available free of charge at berotex.net in a form that allows to gain, replay and preserve the content of these Regulations by means of the IT-communication system used by the Service Provider. The preservation, security and the facilitating of the content of the contract considering the Newsletter services succeeds by sending it to the Service User at the electronic mail provided within the registration content of the agreement.

  16. The Service Provider recommends to review the Privacy policy and the use of web cookies on the services run by P.P.H.U."BEROTEX" JAROSŁAW MAJTCZAK headquartered in Łódź, available on the website under the address: www.berotex.net
