What are the main objectives of the privacy policy and the use of web cookies on our websites acclaimed by P.P.H.U. "BEROTEX" JAROSŁAW MAJTCZAK?

1. The present document enclosing the privacy policy and the use of web cookies on all our websites and domaines:

  • berotex.net,

 

(hereinafter jointly referred as to „Social Network/Services”) was created and acclaimed by Jarosława Majtczaka running the enterprise under the name P.P.H.U."BEROTEX" JAROSŁAW MAJTCZAK headquartered in Łódź (93-613), ul. Kolumny 221, entered into the Business Activity Central Register and Information Record System, chaired by the Minister for Development, having the VATIN: 7291832386 and TIN: 471424703 (hereinafter called: „BEROTEX”) in order to:

 

  • underline the particular importance that we pay to protecting the privacy policy of the visitors to our Social Network.

  • provide the users with a proper information concerning the use of web cookies in our Social Network, required by the provisions of the Act of July 16, 2004. Telecommunications Law (D. A. No 171, item. 1800, as amended), hereinafter referred as to „The Telecommunications Law”, as applicable since March 22, 2013.

 

2. Here below, all the rules considering the collection and the use of our Social Network user’s information have been concluded, as well as the procurement of the service provided electronically, the object of which is to provide – without any payment in this respect – the newsletters.

3. We ensure that our ultimate objective is to guarantee the users of our Social Network the protection of their privacy at least being equivalent to the standards set out in the existing legislation, in particular in the Act from July 18, 2002 on the electronic services, hereinafter referred to as „The Act on electronic services”, the Act of August 29, 1997 on the protection of personal data, hereinafter referred to as the „Act on the Protection of Personal Data”, as well as the Telecommunications Law.

4. We also ensure that we are to comply with the legal regulations, in particular those that protect the privacy of the users of the online services.

 

What kind of information do the Services gather on the users and how they use them?

Services limit the collection and the use of information about their users to the absolute minimum required to provide them with the services at the desired level, according to the Article 18 of the Act on electronic services. In particular, by collecting the personal data we distinguish those among them whose application is actually obligatory for the provision of electronic services. Providing other personal data (ie. Data that are not necessary for the implementation of electronic services), is not obligatory, it lies in the realm of the recognition of the person to whom those data correspond and their processing by BEROTEX depends on its consent.

We emphasize that only in some cases, e.g. When you subscribe to free newsletters, surveys or the order forms, we gather more detailed information about the users, such as e-mail addresses or other personal information (see also the answer to the next question).

We ensure that all personal data, if they were collected within the Services, are mainly used to implement the commitments of BEROTEX to its customers. This information is not shared with third parties unless:

  • the prior expressed consent of the person involved for such an action

or

  • the obligation to transfer the data follows (will follow) from the legislation.

 

We also remind that BEROTEX as the personal data administrator within the meaning of the Act on the Protection of Personal Data may contractually entrust the processing of the collected by the Services data to other entitles pursuant according to the Art. 31 cited above Act.

 

How BEROTEX uses information from the order forms, to free newsletters, and other forms of questionnaire surveys conducted in the Services? 

Within the Services, there are the order forms posted, which allow the customers to order offered by BEROTEX products and services. The data thus collected are used primarily to meet its obligations to (in order to supplement this statement also read the answer to the previous question).

In particular, the subscription to free electronic newsletters issued by BEROTEX requires the appropriate e-mail address. This field is mandatory. Obtained as shown above data is added to the list of e-mailing. E-mail is necessary for this to be able to send the ordered newsletter to the reader.

Customer contact information are also used to make contact with them, when necessary (e.g. If you need to confirm the procurement). At any time, users of the Services, who ordered the newsletter, have the opportunity to resign from its delivery; look below for the answer to the question: „How to unsubscribe from our selected services?

Other information is used to determine the profile of people using the service and ordering the newsletter and allow you to better adjust the content of the Service and the newsletters to the needs of people who use this form of information. Yet, its processing always takes place in accordance with the provisions of the Law on Personal Data Protection and the Law on electronic services (see also the answer to the next question).

 

What actions do BEROTEX undertake when it comes to the information that the access logs contain?

We collect information on the use of the Services by its users and their IP addresses based on the analysis of access logs. We use this information to diagnose problems with the performance of the server, the analysis of potential security breaches and the management of the website. The IP address is used by us too for the statistical purposes, i.e. The collection and the analysis of demographic data of the site visitors (e.g. Information about the region, from which the connection was made). However, we ensure, that this information is in no way associated (combined) by BEROTEX to personal data of the Service users, in particular, with the data of the subscriber’s e-mail lists and other services provided by this service.

Based on the obtained as shown above information, in special cases we prepare collective, general statistics, disclosed to third parties, cooperating with us. They usually include information about the viewing figures of the service. These statements do not contain, however, what we emphasize, any data enabling identification (the identity establishing) of the user of the Service.

Please be informed that we may be required to disclose information about the IP address of the user of the Service at the request of the entitled – on the basis of existing legislation – state authorities in connection with the proceedings conducted by them.

 

What is a web cookie?

Before explaining this concept, we inform that the term „web cookie” as used herein refers to the web cookies and other similar tools described in the Directive 2009/136/EC of the European Parliament concerning the processing of personal data and the protection of privacy in the electronic communication sector (Directive of privacy and electronic communications) and Article. 173 Telecommunications Law.

Web cookies are small text files stored on your computer or other mobile device during your use of the website. These files serve, among others, to the use of various functions provided on a web page or a confirmation that the user has seen certain content of the website.

 

What is the BEROTEX’S purpose to use the web cookies on its Services?

Among the web cookies we can distinguish those that are necessary for the proper operation of the BEROTEX services. Belonging to this category web cookies, are used to provide:

  • the maintenance of the user’s session;

  • the user with a saved session;

  • a possibility to authorize with the use of the Service logon;

  • the storage of information that allows anonymous user logging;

  • the storage of information necessary to operate an online cart for online shopping through the BEROTEX websites;

  • the monitoring of the availability of the services.

 

Another category of the web cookies, are the files that, although are not necessary in order to use the BEROTEX Services, but they make it easier to use them. They are used to enable:

  • the restoration of a recent view the next time you log into the product;

  • to remember the user’s choice on the cessation of viewing the message or only by showing it at a determined amount of times;

  • the restoration of the user’s session;

  • to remember the last category of the product;

  • to check whether the record for web cookies is functioning properly;

  • to allow automatic login to the product („the remember me” option);

  • the adjustment of the product content to user’s preferences;

  • to set the preferred language, currency, font size and other such features to facilitate the functioning with the application;

  • to restore the last search result in the product;

  • to display the recently viewed products in the online store;

  • to display the last selected sorting parameter.

 

BEROTEX also uses the services of the third parties, the list of which is constantly changing, which use web cookies for the following purposes:

  • monitoring of the traffic on our Web sites;

  • to collect anonymous, collective statistics that allow us to understand how users use our website and allow us to continuous improvement of our products;

  • to determinate the number of anonymous users of our Websites that we need to analyze the use of the BEROTEX services;

  • to monitor how often a selected content is shown to users;

  • to monitor how often users choose a certain service;

  • to examine the information on in newsletters;

  • to use the service of personalized recommendations for e-commerce:

  • to use the communication tools;

  • to integrate with the social services;

  • for Internet payments.

How to manage web cookies?

The user can manage web cookies used by BEROTEX or by any other external suppliers by changing the settings of your web browser.

BEROTEX  reserves, however, that after the rejection of web cookies, some of the features offered by our Services may not function properly, and in some cases this involves a complete lack of possibility to use some of the selected Service’s functionalities.

 

How BEROTEX protects the privacy of people who do not have full legal capacity?

We reserve that the Services do not collect, do not monitor and do not verify information about the age of people visiting him or others whose collection would enable to determine whether a user (including the recipient and the user e-mail lists, participant surveys and the person participating in promotions organized on his forum) has the capacity to act.

Those that do not have the full legal capacity should not place orders or subscribe to the services provided by the Services, unless their statutory representatives agree to it, if such a consent will be sufficient under the applicable law.

 

What kind of security is used by BEROTEX?

Services are provided with security measures to protect data, remaining under our control, from their loss, misuse or alteration. We are committed to protect any information disclosed to us by Members in accordance with the standards of safety and confidentiality.

The right to access to personal data of the users of the service were in a restrictive way limited so that the information would not be in the hands of unauthorized people. The access to personal data is only provided to a limited number of authorized BEROTEX employees in accordance with the Law on Personal Data Protection Act and the regulations thereunder.

BEROTEX services offer users the possibility to resign from obtaining the ordered BEROTEX newsletters. The services provide users with the option to remove the information about themselves from our database and they enable the suspension of sending information via e-mails. This can be done by following the instruction attached to the content of the messages sent by us.
